Harvey distinguishes two types of subcontracting, one of which delivers flexibility without fragmentation (a traditional sort of subcontracting) and an emergent form that yields flexibility with fragmentation. Fragmentation consists of parceling out similar jobs to almost identical subcontractors, who then are encouraged to compete with each other on the job site for further work. Thus, subcontractors do not form a team of cooperative specialists but rather a collection of competitors through the work process.

Collective bargaining varies widely in the United States, with, for example, over 50 per cent of the Illinois construction workers being unionized while less than 2 per cent of the North Carolina construction workers are unionized. Currently, 31 states have prevailing wage regulations while 19 states do not. Where public construction involves federal funds, a federal prevailing wage law applies regardless of whether there is a state prevailing wage law in effect in that area. Prevailing wage regulations do not cover private construction, but many private contractors, particularly in prevailing wage law states, negotiate through collective bargaining.

The government applied, after consultation with representatives of the industry, many of the standardized model contracts and specifications for output and performance that had been developed earlier by business associations in the industry. These criteria were defined in terms of measurable minimum requirements to be respected by contractors. Similarly, the sector has a long tradition of developing production standards. Nowadays, this development is done by the private Netherlands Standardization Institute (Nederlands Normalisatie-instituut, or NEN).
